B Basnet, Political Secy to CM has shared , ‘Today, a double bench of the National Green Tribunal (NGT) at the Kolkata Court dismissed the long-pending case concerning the West Point Mall in Gangtok (Case No. 38/2022/EZ).
The case, originally filed by Dr. Bina Basnet (Shanti) against the State Government, had raised environmental and regulatory concerns regarding the construction of the fourteen-storied mall.
The online judgment was delivered by Justice B. Amit Sthalekar, Judicial Member, and Dr. Arun Kumar Verma, Expert Member of the NGT, Kolkata Bench.
Dr. Basnet had challenged the State Government’s approval of the project, citing potential adverse impacts on the local environment. However, after a thorough review, the tribunal ruled that the project complies with the required guidelines and dismissed the petition.
The final judgment reads:
“Upon a consideration of the facts of the case and the submissions of the learned Counsel for the parties, we find no merit in the present Original Application and the same is accordingly dismissed.”
Sources have also confirmed that IIT Roorkee vetted the West Point Mall project, further affirming its compliance with engineering and safety standards.
